By booking accommodation at Hillsmore Cottage, Overton Lane, Arlingham GL27JJ, you are agreeing to the following terms and conditions

The Booking

1.1 your booking of Hillsmore Cottage, is with the Business Hillsmore Cottage furnished holiday let, Helen Merrett, Oldbury Farm, Overton Lane, Arlingham, GL27JJ referred to in this document as ‘Hillsmore Cottage’ Reference to you or your group are reference to the person or organisation making the booking with Hillsmore Cottage.

1.2 These terms apply to bookings made via Hillsmore Cottage website, by email, or telephone or in person with Helen Merrett.

1.3 Your booking is confirmed and a legal contract concluded once your payment has been successfully made. No booking is made or contract concluded when payment is declined or unauthorised.

1.4 You agree that the booking is for a short term stay for leisure, business or temporary purposes and does not give rise to an assured shorthold tenancy or lease.

1.5 Bookings can be for any length from one night up to 3 months. Bookings must be made at least 2 days before arrival.

1.6 Bookings may only be made by a person aged 18 or above and there must be at least one person aged 18 or above staying in the accommodation.

1.7 You may not resell or re-assign your booking to any other person or organisation except with the express authority of Helen Merrett.

1.8 if you or any member of your party has any medical problems or disability that may effect your booking, please tell Hillsmore Cottage before your booking and give us full details in writing as early as possible before you travel. Hillsmore Cottage is a period cottage with steep and narrow staircases. The property is not all on one level downstairs and is unsuitable for wheelchair access both internally and externally. Hillsmore Cottage reserves the right to cancel or refuse a reservation if it is unable to make adjustments to meet that persons particular needs.

Payment and Cancellations

2.1 Payments must be made on receipt of an invoice from Hillsmore Cottage by bacs transfer.

2.2 A non-refundable deposit payment of 25% secures your dates. If you cancel your stay the full standard deposit amount is taken as a cancellation charge.

2.3 Full balance payment must be made 10 weeks prior to booking start date, on receipt of a balance invoice.

2.4 The total price for your entire stay will be presented to you before you confirm your booking and make payment. Price is for the whole property and not per person, except where an extra person charge is applied for over 4 people only available at the discretion of Hillsmore Cottage.

2.5 Any refunds in relation to balance payments are entirely at the discretion of ‘Hillsmore Cottage Furnished holiday let’ and will only be available if it is able to book out the accommodation to other guests, in which case it shall make a refund to you of your booking cost, less any difference in price where the replacement booking was of a lesser value. No refunds will be available if cancelled within 10 weeks of the booking start date. For more flexible booking terms – you may book instead through www.cottages.com

2.6 no refunds are available in the event that you cut short your stay

Cancellations due to government public health measures for Covid 19

If due to government public health measure it becomes unlawful to travel to or make use of the accommodation you have booked you may choose to

a) transfer your booking to a later date free of any administration charges subject to availability – you will have to pay any difference in price if the cost of the new booking is higher or be reimbursed the difference if the cost is lower.

b) Obtain a refund of the amount already paid by you for the booking less any administration costs which we incur in processing your refund.

Stay

3.1 Check in time is from 4pm, check out time is no later than 10am. Hillsmore cottage may request an additional payment for early check in or later check out and cannot always be available. Information on the check in and check out procedure and access to the cottage will be provided separately.

3.2 Included in your stay will be bed linen & towels. A cleaning service of stays of a week or more can be provided. Weekly cleans are non negotiable and chargeable on bookings of over 2 weeks.

3.3 You are responsible for the conduct of all persons and their animals staying within the accommodation and shall ensure that they comply with all these terms and conditions.

In particular you and your guests MUST NOT

3.3.1 smoke in the premises. You and other guests may only smoke outside of the premises. This includes e-cigarette and Vaping. Candles must not be used in the cottage, they are not provided and must not be used on the property.

3.5.2 bring any pets that have not been expressly agreed by Hillsmore Cottage with the exception of assistance dogs.

3.5.3 bring any potentially dangerous or hazardous materials or equipment onto the premises

3.5.4 tamper with any fire alarms or emergency equipment

3.5.5 Remove, damage or destroy any Hillsmore Cottage property

3.5.6 use any technology provided by Hillsmore Cottage to download or access any unlawful or obscene material

3.5.7 cause unreasonable disturbance to neighbouring residents of Hillsmore Cottage

3.5.8 make excessive noise particularly after 10pm especially from TVs and other electronic devices.

3.5.9 fail to return your key at the end of your stay, as in the interests of security we may have to charge you for replacement of locks.

3.5.10 hold events such as parties celebrations or meetings, including the hiring in of equipment at Hillsmore Cottage without the advance notice and express permission of the owner. If you do, the owner can repossess the accommodation. In this situation you will receive no refund of any money paid for the booking. Hillsmore Cottage are under no obligation to find any alternative accommodation for you

3.4 you and all members of your party agree to keep accommodation clean and tidy, leave the accommodation in a similar condition as you found it, behave at all times in a way that does not break any law, use the accommodation for any illegal purpose

Pets

Pets that have been agreed upon booking, (3.5.2) must not be left alone in the property unless crated securely and must stay downstairs and off furniture in the property at all times.
If you or any member of the party has a pet allergy, Hillsmore Cottage cannot guarantee that dogs or other pets have not stayed in your chosen accommodation even if the owner does not allow pets, nor can Hillsmore Cottage accept any responsibility for any subsequent health reaction. If there is a charge for pets you will be told at the time of booking.

Damage Theft and costs

4.1 Hillsmore Cottage reserve the right to charge a fee to provide security in respect of

4.1.1 the cost of replacing or repairing any property of Hillsmore Cottage including furniture fittings appliances or other fixtures and items which are damaged during your stay.

4.1.2. the cost of replacing any items which are stolen from the accommodation during your stay

4.1.3 any breach of our non smoking policy. A standard charge of £100 will be charged where we find evidence of smoking withing the accommodation to cover cleaning costs but we reserve the right to charge additional amounts to cover any damage caused by smoking.

4.2 such costs may be charged on check out but Hillsmore Cottage reserves the right to apply such charges to your card at a later date where necessary. Where Hillsmore Cottage is unable to apply such a charge against your card then an invoice will be sent to you which you agree to pay within 14 days of receipt.

4.3 Hillsmore Cottage will provide a receipt including a breakdown of costs for all additional charges made to your card or invoiced.

GDPR

5.1 Hillsmore Cottage processes information provided by you when making a booking and upon check in. By providing this information you consent (on your behalf and the behalf of each member of your group) to such processing and you warrant that all information provided by you is accurate.
5.2 When paying a deposit for a booking – you are agreeing to Hillsmore Cottage contacting you in relation to the bookings, any future booking, or any information required about your stay or furutre stays. You may OPT OUT at any time by contacting Helen Merrett

Limitation of liability

6.1 The liability of Hillsmore Cottage to you under these terms and conditions shall be limited to the total value of your booking except where such a loss is caused by our negligence, in which case it shall be limited to any direct and reasonably foreseeable loss suffered by you.

6.2 Hillsmore Cottage shall not be liable in any circumstances to you for any consequential or indirect loss including loss of profit, data, management time reputation or goodwill.

6.3 Hillsmore Cottage shall not be liable for any damages or loss caused by conditions or events beyond its control including, but not limited to acts of god, acts of war or terrorism, civil strife, significant risks to human health such as outbreak of serious disease (including epidemics pandemics and the ongoing effects of covid 19), acts of government or local authority including port or river authorities, natural, nuclear, chemical or biological disaster and all similar events outside of the Hillsmore Cottages control.
